Canada border services gone too far?

There is a growing concern over Border Officers power to seize and search cell phones and laptop or any technological items. As more people travel with laptops , smart phones and any kind of item stores personal or common information it seems if Border Officers suspect or even just want to find out any kind of information they can seize anything. A Canadian border officer seized a Toronto Lawyers laptop and smartphone because he refused to give them the passwords in order to view the contents ..says the lawyer he has alot of lawyer information is highly delicate and private..it breaks the /lawyer confidentiality. "The policy is outrageous and should not be allowed ..It is a breach of our constitutional rights."says Nick Wright a business lawyer from Toronto. Nick says he just got back from Guatemala and Columbia where he had been taking a Spanish to better understand his wide range of who are not fluent in English..He says he often takes trips to remote parts of the world to better understand and learn different languages of the ethnic cultures he serves..
But Nick says he drew the line when a border officer demanded his passwords to his laptop and phone.Upon Nicks refusal the Officer seized both items and said they would be sent to a Government lab and they would crack the codes there and search whatever files they needed.
According to the CBSA it has the right to search electronic devices at the border for evidence of custom related offences , without a warrant ..just as it does for luggage.If travellers refuse to provide passwords Officers can seize the items.A growing number of Lawyers across Canada argue warrantless digital device searches at the border are unconstitutional and the practice should be stopped or at least limited.
My personal opinion here:
I think it is the Border laws acting on outdated and unconventional means of invading a persons privacy and constitutional right to privacy..it is barbaric and uncivilized..Yes if the border suspects a person has things to hide then person should be handled in a different way and not the common person who is a business man travelling for business. ..There should be different practices for different reasons making someone feel like a criminal who is not a criminal is also a barbaric approach to making people feel safe..

yes living off grid is a way of avoiding this kind of confrontation but say if you had to travel some day for whatever reason and your privacy was invaded like this and it is not in your power , as so many people like to think, would you not protest whether you had something or nothing to hide? I certainly would but being a common person today is not any more common than the highest power possible when one is made to look like a criminal in the eyes of the public...

It definately is .,.Being a common general person today is not possible especially when people are made to feel like a common criminal then common as the term is would be rightly attached to the common person...Members of the public that are going about their daily routine should not have to be looked on as criminal..soon we will all have to be fitted with wrist bands and bar codes so that way the Law Officials knows what we are doing second by second..outrageous behavior indeed...overkill..

They are definitely taking this way to far, as those right are supposed to be protected. It just amazes me the way things are being run these days. Thanks for sharing this with us hun as I had no idea this was going on. I hope you have a peaceful Sunday..

well the security laws are totally outdated and are Neanderthal ..they need to be renewed and Border Officers need to be better schooled in tact..They have the right to do inspections as per laws but only if they suspect there may be underhanded business going on ..and who is to say that someone who travels for business and only business needs to be treated like a criminal..These guys know who travels every time they board a plane so why would one trip be any more different than the last ?

thanks and yes i agree the laws are overkill and neanderthat to say the least ..those laws are obsolete and no business man who travels solely for business is going to be quiet about it or even common people travelling to see family what are they suspects as well ..criminal and treated as such...On another note i seen my fwb yesterday first time in 5 weeks , hes very busy , lol i am feeling the effects today i am so sore all over..ha a good sore my body aches in a good way...wink!

Those particular laws have only been imposed since post 2011 not really outdated..I'll grant you they are only random searches.... A person should have nothing to hide on their devices if they are traveling ..anybody who works with computers knows there are other ways to retrieve your information once you arrive at your destination with out taking it with you
